GENERAL SALE CONDITIONS

  1. Acceptance of general sales conditions and formation of contract

1.1 The contract stipulated between Aurora de Matteis (from now “AdM”) and the Client (that is any physical person making a purchase on the website, independently of any commercial, business or professional activity they exercise) is intended validly concluded with even partial acceptance of a purchasing order by AdM. In case such an order is not accepted, AdM will immediately communicate this fact to the client.

1.2. Placing an order in one of the modalities provided, on the basis of the form on the website (from now on “Order”), the Client declares that they have read all instructions provided during the purchasing procedure and accepts all the general conditions (from now on “Conditions”).

1.4. The following Conditions may be printed or saved on a durable format, in compliance with art. 12 of Legis. Dec. 70/2003 and art. 51 of Legis. Dec. 206/2005, as amended by Legis. Dec. 21/2014.

  1. Terms of purchase

2.1 Products sold by AdM are solely the ones present on the AdM website at the time of placement of the Order, as described in the related profiles.

2.2 For all purposes, all images connected with the description profiles of a product are to be intended only as mere information and cannot be intended as perfectly representative of the products’ characteristics, that may differ, e.g. by colour or dimensions (also due to the browser and the monitor used to access the Site and to visualize the images).

2.3. To place an order, the Client must fill in every section of the related form, present on the Site and send the latter after carefully reading the Conditions, as well as the characteristics of the product and/or products they intend to purchase.

2.4. The correct receival of the Order by AdM shall be notified to the Client via mail, sent to the email address submitted by the Client. This confirmation message will briefly outline the purchasing conditions, in compliance will applicable Law, as well as all data contained in the Client’s Order, so as to allow the latter to verify the Order and request the correction of any errors.

  1. Prices and Payment methods

3.1. The prices indicated on the Site include both taxes and VAT. Additional shipment and payment costs will be communicated to the Client with due notice, via the website or the present Conditions.

3.2. Le following ways of payment are possible

(a) PayPal

In order to make a payment a client may use the PayPal circuit according to the modalities provided for by the latter.

AdM will not be able to access a Client’s credit card details in any case and during any phase of the payment process. No digital archive of AdM will store such details so AdM will not be held liable for any possible improper or fraudulent use of credit cards by third parties at the moment of purchase.

(b) Wire transfer

In case of purchase using wire transfer, the relevant banking coordinates will be visualized. The shipment of merchandise will happen only after successful receipt of the wire transfer by a bank.

  1. Delivery of products and related costs.

4.1. Products purchased will be delivered to the address indicated by the Client in the Order within 2 to 17 working days, including courier time schedule for the delivery of acceptance of the Order by AdM, at the cost indicated by the Site before sending the Order. AdM reserves itself the right to accept orders from outside Italian or EU boundaries. In any case, for deliveries outside of Italy, shipment and delivery times may undergo variations.

4.2 In relation to deliveries to countries outside of the EU, possible customs and import costs will be paid by the Client. The latter is requested to contact in advance Customs authorities so as to verify import costs and any import limitations.

4.3. Delivery times indicated by AdM vary according to the product ordered (2 days plus courier schedule times for warehouse products; 5 days plus courier schedule times for delivery of products “Made to ship” and a maximum of 17 days plus courier schedule times for the delivery of custom-made products) a delay in these times, or any delivery in instalments does not give the Client a right of refusal, as well as requests for payment of damages and indemnities.

4.4 At the moment of delivery the Client must check:

That the number of items delivered corresponds to the one indicated in the transport document, all packaging is intact, that it does not present any damage, is not humid o altered in anyway including all packaging materials (e.g. cello tape or metal strappings).

Any damage to the packaging and/or to the product or a different number of items delivered or mistakes in the indications must be immediately signaled, indicting specifically all the latter in the delivery document that must be handed back to the courier.

 

Any problems regarding the physical integrity of, the conformity or the completeness of products received must be signaled within 7 days of delivery, according to indications in the present document.

  1. Right of rescission

5.1. According to art. 52, Legis. Dec. 206/2005, as amended by Legs. Dec. 21/2014, the Client has the right to recede from the Conditions and also from the contract for any reason, without giving reasons and without penalty, within 14 (fourteen) working days from the date of delivery of the products.

5.2. In order to recede from the contract on the basis of art. 5.1, the Client must send AdM a communication, within terms indicated, to the following email address: resi@auroradematteis.it, or using the form present on the website.

5.3 In case of rescission the Client may, at his/her own cost, have the products shipped back to AdM, within 14 (fourteen) days from the exercise of such right, to the following address: Aurora de Matteis – Via Maria Vittoria, 31 – 10123, Turin (TO). All items must be returned whole, including original packaging (envelopes and boxes), they must be kept safely and used only for the purpose of establishing their nature, characteristics and sizes, using diligence and keeping them free of wear and dirt and respecting the following conditions:

– Rescission does not apply to products that were custom made according to instructions by the Client;

– Rescission applies to an item as a whole; it may not by exercised with respect to parts of an item (e.g. accessories or additions); the right to recede from the contract is possible only when a product is intact and returned inside its original packaging, complete in all of its parts (including packaging material, documentation and accessories: labels, tags, seals, etc.).

-In case of damage of goods due to transport, AdM will communicate such a fact to the Client, so that the latter may claim damages from the courier; the product will be given to the Client, with cancellation of the request to recede from the contract;

-AdM is not liable for damage, theft or loss, occurring or due to the return shipment of products.

5.4 AdM will refund the Client of the entire amount paid, net of supplementary delivery costs according to article 56, comma 2, Legis. Dec. 21/14, within 14 (fourteen) days of rescission of the contract, via transfer of the amount due, using the same means of payment as the Client for the initial transaction, unless a different method has been agreed upon. In any case the Client shall not incur in any cost linked to refund. AdM may suspend the refund until receival of the product or until the Client proves to have correctly shipped back the product.

5.5. In any case, the Client shall lose the right of rescission against AdM if the latter ascertains that:

the returned product and/or its accessories and/or its packaging are damaged

the product is lacking external packaging and/or its packaging material;

the product lacks integral elements and/or accessories (e.g. zips; straps; buckles; etc.).

In case of loss of the right of rescission, AdM shall resend the purchaser the product bought, charging delivery costs and reimbursing the cost of the item.

  1. Warranties

6.1 All items of clothing sold by AdM are of high quality standard, legal warranty of the latter is given directly by the producer. In order to use warranty assistance, the Client must keep the invoice or receipt of payment together with transport document.

6.2 Warranty for defect of compliance shall apply, as long as the relative item has been used correctly, respecting its appropriate purpose and what is provided for in the instructions for use and washing.

6.3. In cases where warranties provide for the return of the product, the latter must be returned by the Client in the original packaging, complete with all its parts (including packaging material, with any documentation and accessories).

  1. Complaints and information requests

  1. Limits to liability

AdM will not be held liable towards the Client, except for cases of voluntary breach of terms and conditions or gross negligence, for any disruptions and malfunctioning of internet services that are beyond its control or the control of its providers.

AdM will not be held liable for damage, losses or costs incurred by the Client for failed execution of the contract for reasons beyond its control.

AdM does not take responsibility for any improper or illegal use by third parties of credit cards and other means of payment.

  1. Force Majeure

AdM shall not be held liable per delay or failed execution of its obligations under a contract in case of events that are beyond reasonable control, due to force majeure or, in any case, unforeseen and unforeseeable events independent of its will.

Implementation of obligations by AdM shall be intended as suspended in any case of force majeure.

AdM shall do all in its power to establish solutions that allow a correct fulfilment of its obligations even in presence of events of Force Majeure.

  1. Links to third party sites

The website may contain links to sites/apps belonging to third parties. AdM has no control over the latter and so shall not be held responsible for the contents of such sites/apps.

Some of these links may connect to websites/apps of third parties providing services via the site. In such cases, the same general conditions and usage rules shall apply to these single services and the related sites/apps; for the use of services provided for by third AdM shall bear no liability.

  1. Privacy

Personal data gathered by sending the Order will be used by AdM with the sole purpose of satisfying the Client’s requests, in compliance with EU Regulation 679/2016 and the Privacy Notice on the present website. Any ulterior use of such data shall be undertaken with the explicit consent of the Client.

The protection and use of personal data will occur on the basis of the Privacy Notice, that can be accessed at the webpage https://auroradematteis.com/privacy

  1. Law Appliable

The sales contract with the present conditions and its related execution are regulated by Italian Law, with no application of the United Nations’ Convention for the International Sale of Goods. Any eventual legal dispute will be solved before a court in the Client’s city of residence.

Items may be returned by courier. If you wish to return an article, you must notify AdM the reason for this at the following email address: resi@auroradematteis.com, you must specify the date of receival of the item. From the date of notification you have an additional 11 days to return your item, sending it to the address which will be specified on the label of the returned item.

We request that you follow these instructions:

Returns using a courier:

Once the request to return an item has been approved you will receive an email with a pre-paid shipping label.
Place the merchandise that you wish to return inside the original packaging.
Print out and place the pre-paid label on the box and organize for it to be collected by directly contacting the courier at the number indicated in the email requesting a return. All returned items sent using the pre-paid label are free. Please bear in mind that AdM is not responsible for merchandise returned using a different courier service; we recommend you use the pre-paid label.
If by any chance you should not receive the pre-paid label, do not hesitate to contact us. The number to track the courier is written on the pre-paid label. Please refer to this number to monitor the status of returned items.
Once received at headquarters, returned items will be handled with within 14 working days and accredited via original payment. You will receive an email of confirmation when the return procedure has been completed.

How do I change an Item?

Changes of items may be made via courier. Items must be returned in their original conditions within 14 working days from their receival, at the address specified on the delivery label of the returned product.

Once delivered to the warehouse, changes will be processed within 14 working days. If the new item has a lower or higher cost than the original, you will receive a refund or a new charge for the difference.

You will receive an email of conformation when the return procedure has been completed. Any delivery costs paid for at the moment of purchase are not refundable.

For orders placed through PayPal, changes are possible only for products of lower or identical value. If you are requesting the change of a product of lower value, you will receive a partial refund directly on your PayPal account.

To change items of lower cost paid for via wire transfer, you will receive a refund of the balance. If you wish to change your item with a new one having a higher cost, we request payment of the balance via wire transfer.
